<p>A motorcyclist may have a higher chance of suffering from injuries at night since <a href="https://www.nsc.org/road/safety-topics/driving-at-night#:~:text=Stay%20Alert%2C%20Stay%20Alive,night%20is%20always%20more%20dangerous." target="_blank" rel="noreferrer noopener">half of all vehicle accidents</a> happen when the sun is down. Here are some common <a href="https://www.insurance.harley-davidson.com/the-open-road/safety/riding-a-motorcycle-at-night" target="_blank" rel="noreferrer noopener">nighttime dangers for motorcyclists</a>:&nbsp;</p>

<p>A distraction can cause a driver to look away from the road and take their hands off the wheel. <p>On a recent day in Detroit, a tire flew off a vehicle traveling southbound on I-75, bounced over the median and went into the northbound lanes, where it struck a second vehicle, <a href="https://www.fox2detroit.com/news/nb-i-75-closed-at-davison-for-crash-msp-warns-expect-large-delays" target="_blank" rel="noreferrer noopener">causing the second vehicle to crash</a>. The driver of this second vehicle was killed. According to a news report, this car accident occurred in the late afternoon during clear driving conditions, and the driver of the first vehicle stayed to provide authorities with information following the accident.</p>



<h2 class="wp-block-heading" id="h-state-data-around-car-crashes">State Data Around Car Crashes</h2>



<p><a href="https://www.michigan.gov/msp/-/media/Project/Websites/msp/cjic/Traffic-Crash-Reporting-Unit-Files/YE-2021-FINAL.pdf?rev=b4171a384a9249c2be03abe0607abe68&hash=DCA2BDBE469FED696F120716529B94EE" target="_blank" rel="noreferrer noopener">Michigan state crash data</a> provided more details in the most recent 2021 statewide report on accident frequency.&nbsp;For the year 2021, there were over 280,000 motor vehicle accidents, with over 1,000 fatalities and 70,000 injuries.</p>



<p>The state reported an increase in the percentage of each of these data points: overall accidents, fatalities and injuries compared to the previous year of data.</p>



<p>In addition to all of these physical injuries, the state also recorded over 1 million property damage cases in the past five years of data collection.</p>

<p>In the case in question, a talented baseball player from New Jersey and his father died in a collision with a semi tractor-trailer in a construction zone on I-75. Plaintiffs uncovered evidence that the driver of the truck was careless, that he suffered from Parkinson’s disease and that he had several other physical ailments that should have caused his employer to restrict his driving.</p>



<p>The young man who died was only 20 years old and had shown himself to be a promising pitcher. At the time of his death, he had enrolled in Florida State University and was attracting the attention of major league scouts. After the crash, the player’s high school said that the boy’s jersey number would be retired.</p>



<h2 class="wp-block-heading" id="h-the-response-of-challenger-motor-freight">The Response of Challenger Motor Freight</h2>



<p>The semi tractor-trailer was owned and operated by Challenger Motor Freight. The company had acknowledged fault for the accident but decided to submit the issue of damages to the jury. The company, which is based in Canada, offered condolences to the family but nevertheless announced its intention to appeal the damage award. Its attorney described the accident as “tragic” but said that the verdict is “highly excessive for several reasons.”</p>



<h2 class="wp-block-heading" id="h-who-is-liable">Who Is Liable?</h2>



<p>The defendant’s <a href="/practice-areas/auto-accidents/">decision to concede liability</a> and restrict the case to damages was most likely a tactical choice intended to keep the facts of the accident hidden from the jury, probably in the belief that the fairly obvious fault of the company would only exacerbate the amount of damages. <p>When you are in an accident with a large truck, the situation is a little bit different.</p>



<p>You are not only more likely to have suffered serious injuries, due to the large size of the truck, but the truck driver was technically “working” at the time of the crash, so you will need to collect additional information.</p>

<h2 class="wp-block-heading" id="h-emotional-trauma-is-common">Emotional Trauma Is Common</h2>



<p>Emotional trauma is exceedingly common immediately after an accident. Indeed, the most common emotional impact is shock and disbelief. Luckily, for most car crash victims, these feelings pass quickly.</p>



<h2 class="wp-block-heading" id="h-post-traumatic-stress-symptoms">Post-Traumatic Stress Symptoms</h2>

<p>As these symptoms progress, you could begin to feel disconnected from others. And, you may find it impossible to think about anything other than the car accident, like the accident is on a non-stop loop in your brain.</p>

<p>You can start with your primary care physician, who can likely make a referral. Even if they cannot, your PCP can work with your therapist or counselor as a team to make sure your mental and physical well-being is treated equally.</p>

<p>As a society, we can all now agree that drinking and driving is dangerous. But, texting and driving is equally as dangerous. To drive this point home, the <a href="/practice-areas/auto-accidents/">National Highway Traffic Safety Administration</a> says that just five seconds of texting and driving is the same as driving a football field in Livonia, Michigan, blindfolded.</p>



<h2 class="wp-block-heading" id="h-more-dangerous-than-drinking">More Dangerous Than Drinking</h2>



<p>According to the NHTSA, distracted driving, like texting and driving, is now the leading cause of motor vehicle accidents in the United States. And, most of that distracted driving is attributed to texting and driving.</p>



<p>Texting and driving killed nearly 400 people in 2020 people alone, or more than a person a day died as a result of texting and driving. However, in 2020, tens of thousands of other Americans were injured, including seriously injured, <a href="https://www.forbes.com/advisor/car-insurance/texting-driving-statistics/" target="_blank" rel="noreferrer noopener">as a result of texting while driving</a>, even in Livonia, Michigan.</p>



<h2 class="wp-block-heading" id="h-it-is-a-known-issue">It Is a Known Issue</h2>



<p>Unfortunately, we cannot say that we do not know this is an issue either. According to a survey by AAA, nearly every driver they surveyed (96%) said they believed texting and driving was a serious threat. Yet, almost half of those same drivers admitted to doing it nonetheless. It is clear that we have an issue that is not going to stop by itself.</p>



<h2 class="wp-block-heading" id="h-the-takeaway">The Takeaway</h2>



<p>This is not just an issue in Livonia, Michigan, but a national issue across the United States. However, when it happens locally, it impacts us acutely because we feel it. But, when this negligence does happen, we do not have to take it without recourse. We can fight back against the other person’s negligence with a personal injury lawsuit. While it will not take away our pain and suffering or unbreak our car, it can get us our sense of justice back.</p>

<p>People in the Detroit area are continuing to use e-scooters, e-bikes and similar devices to get around urban areas.</p>



<p>While their availability may convenience the public for years to come, these modes of transportation come with risks as well.</p>



<p>According to the U.S. Consumer Product Safety Commission, or CPSC, through 2020, the <a href="https://www.cpsc.gov/Newsroom/News-Releases/2021/Injuries-Using-E-Scooters-E-Bikes-and-Hoverboards-Jump-70-During-the-Past-Four-Years" target="_blank" rel="noreferrer noopener">number of people who visited emergency rooms because of these “micromobility devices” has increased each year</a>.</p>



<p>In 2017, the CPSC reported 34,000 emergency room visits. In 2019, 54,800 people visited emergency rooms because of micromobility devices.</p>



<p>Unfortunately, even during 2020, the number of people who visited emergency rooms still increased again, this time to 57,800.&nbsp; The increase happened despite people around the country traveling less in 2020.</p>



<p>The use of electronic scooters drove the overall increase in emergency room visits.&nbsp; According to CPSC, a number of factors are responsible for the increase.</p>



<h2 class="wp-block-heading" id="h-what-are-my-options-if-i-am-injured-in-an-e-scooter-accident">What Are My Options if I Am Injured in an E-Scooter Accident?</h2>



<p><a href="/practice-areas/">Many e-scooter accidents</a> involve more than just the rider of the scooter.</p>



<p>Sometimes, the rider is not being careful, or just does not know how to use the equipment. In other cases, the rider may have just not checked to make sure the scooter was working correctly before trying to ride it.</p>



<p>As a result of these common mistakes, a rider may strike and injure another person on a micromobility device, a pedestrian or someone riding a conventional bicycle.</p>



<p>Under Michigan law, a negligent e-scooter rider is legally responsible for the injuries they cause. They will have to pay medical expenses as well as lost wages and other damages to those they injure.</p>



<p>These sorts of cases can be tricky.&nbsp; They are not like traditional car accident cases. To give just one example, the responsible person’s automobile insurance might not cover accidents on e-scooters. They may have other insurance proceeds available to them.</p>



<p>Someone injured by the rider of an e-scooter may have legal options for obtaining compensation. They should make sure they understand the alternatives.</p>

<p>Recent studies – one by a government/auto industry alliance and one by the insurance industry – revealed that automatic braking could reduce rear-end automobile crashes by 50 percent. Pickup collisions went down more than 40 percent. Both relied on crash data for the calculations and focused on imminent impacts or slow ones to minimize the severity of possible injuries.</p>



<p>The Partnership for Analytics Research in Traffic Safety looked at auto equipment data from 13 states where police reported 12 million crashes. <a href="https://apnews.com/article/technology-business-3a3816bd26418cc612d5b9b56d86f3a8" target="_blank" rel="noreferrer noopener">The data</a> was collected by the National Highway Traffic Safety Administration. In addition to emergency braking, studies also delved into forward collision warnings.</p>



<h2 class="wp-block-heading" id="h-promising-findings">Promising Findings</h2>



<p>Results revealed a 49 percent reduction when the vehicle causing the accident had a forward collision alert in addition to automatic braking as opposed to cars lacking the system.</p>



<p>Specific findings include:</p>



<ul class="wp-block-list">
<li>Rear-end accident injuries are down by 53 percent.</li>



<li>Forward collision warning systems reduced rear-end crashes by 16 percent</li>



<li>Rear crashes with injuries decreased by 19 percent</li>
</ul>



<p>Less-than-ideal conditions of roadways, weather, or lighting were not factors, as AEB functioned effectively in all conditions.</p>



<p>In the category of lane departure warning, crashes were reduced by eight percent when lane-keeping systems were activated, and road departure accident injuries went down by seven percent.</p>



<h2 class="wp-block-heading" id="h-additional-insight">Additional Insight</h2>



<p>A study by the Insurance Institute for Highway Safety also found automatic emergency braking reduces pickup rear crashes by 43% and rear-end injury collisions by 42%. The IIHS noted that pickups – vehicles that present more danger to vehicles sharing the road – are less likely to have automatic braking than cars and SUVs.</p>



<p>Even without government mandates, twenty automobile companies are taking steps to voluntarily commit to making cutting-edge braking technology standard equipment on 95 percent of light-duty trucks. The goal is to complete the transition during the current model year ending in August 2023.</p>



<p>While technology helps keep drivers safe, little can be done about drivers operating their vehicles negligently can still lead to dangerous and potentially deadly accidents.</p>

<p>They are more likely to suffer serious injuries and lose their lives. This can lead to an array of problems for them and their family. Understanding the problem is one thing, but knowing what to do after the accident has happened is another and it is important to have help.</p>



<h2 class="wp-block-heading" id="h-recent-study-puts-michigan-25th-in-rankings-for-pedestrian-safety">Recent Study Puts Michigan 25Th in Rankings for Pedestrian Safety</h2>



<p>In a new report called “Dangerous By Design,” <a href="https://www.freep.com/story/money/cars/2022/07/12/pedestrian-deaths-rising-sun-belt/10033829002/" target="_blank" rel="noreferrer noopener">states were ranked</a> based on pedestrian safety. It looked at how many pedestrians lost their lives in crashes over a 5-year period. While some states were worse than others, this is a national problem. Michigan came in 25th.</p>



<p>Forty-six of the 50 states in the union saw an increase in pedestrian deaths. Since 2009, pedestrian deaths have grown by 62%. Part of this is attributed to the recent national crisis. With fewer drivers on the road and less law enforcement, drivers took that as an opening to behave in ways that they otherwise would not have and it caused more accidents and worse outcomes due to the severity of the crashes.</p>



<p>In 2020, The United States had an average of almost 18 pedestrian deaths each day with a total of over 6,500. This was a spike of 4.7% compared with the prior year. The numbers for 2021 have not been fully accrued and assessed, but the Governor’s Highway Safety Association (GHSA) reported 7,485 pedestrian deaths for that year. This would be the worst total in 4 decades. Part of the problem is how roads are designed and researchers are trying to find solutions to enhance safety.</p>

<h2 class="wp-block-heading" id="h-traumatic-brain-injuries">Traumatic Brain Injuries</h2>



<p>TBIs occur when you experience a violent blow or jolt. And, sometimes, these symptoms will go away, but often, your systems will persist and grow worse without medical intervention.</p>
