As the summer months approach, the period between Memorial Day and Labor Day becomes a time of heightened concern for teen drivers and their families. Known as the “100 Deadliest Days,” this timeframe sees a significant increase in serious car accidents involving teenagers. AAA estimates that eight people are killed everyday during this period in teen-involved car crashes. Understanding the factors contributing to this trend and the legal implications can help families take proactive steps to ensure safety.

What Factors Contribute to Increased Teen Crash Risk?

Several factors contribute to the increased likelihood of teen car accidents during the summer, including:

Increased freedom and time: Teens often have more free time during summer, leading to more driving. Without the structure of school, they may engage in more recreational activities, increasing their time on the road. This may also increase the risks associated with nighttime driving, as teens may be allowed to stay out later during summer months.

Inexperience: Many teens are relatively new drivers. Their lack of experience can lead to poor decision-making and inability to handle unexpected situations.

Distractions: With friends in the car, teens may face distractions that divert their attention from driving. Additionally, the use of mobile devices while driving remains a significant concern.

Parents can use this information to implement strategies to reduce the risk their child is in a crash.

How Can Parents Reduce the Risk of Their Children Getting Into a Car Accident During The Summer?

The driving experts with AAA note that one of the best ways to help teach teens to drive safe is to model safe driving practices. It is also helpful to make sure they complete a driving program at a reputable facility. Some basic rules can also help, such as setting curfews and expectations around putting phones away while driving.

What Are the Legal Implications if My Teen Is in a Crash?

The first step is to determine liability. If the teen caused the crash, they may be responsible for damages. If the crash was caused by another driver’s negligent or reckless actions, you can hold that driver financially accountable. It is important to gather evidence to help build a claim. This could include contact information for any witnesses and copies of a police report.

The increased freedom that comes with summer months should be a time for teens to explore and engage in extracurricular activities. If done wisely, this can mean increased experiences and great memories. In the event of an accident, know that you do not have to go through the legal process alone. Attorneys with experience in these types of situations can review the case, discuss your options, and advocate for your interests.

Sexual assault cases are complex and require careful handling of evidence to pursue justice and fair compensation. The significance of preserving evidence in these cases cannot be overstated.

It is a critical step in building a strong case and holding perpetrators accountable for their actions. What steps can you take to preserve evidence if you or a loved one has been a victim of sexual assault?

Physical Evidence

Physical evidence, such as clothing and bedding, can be essential in building a case. A victim should avoid showering or changing clothes until they have received medical attention. Doing this can help preserve physical evidence that may be collected during a medical exam. A trained nurse or another health care professional typically performs this exam by collecting evidence using a rape kit.

Digital Evidence

Additionally, digital evidence like text messages and social media posts can help create a timeline of events. A victim should save these messages and posts and avoid deleting any that may be relevant to the case. Further, digital evidence can be used to track a perpetrator’s movements and establish a motive. This type of evidence is increasingly important in sexual assault cases.

Testimonial Evidence

Meanwhile, testimonial evidence refers to the statements of the victim or other witnesses. It is important to write down as many details as possible about the assault immediately after it happens. This can help ensure that the story of the victim or witnesses remains consistent and accurate.

Expert Testimony

In addition, expert testimony can support a victim’s claim. This type of testimony may come from a medical professional or a psychologist who has treated the victim. These health care professionals can provide insight into the victim’s physical and emotional state after the assault to help establish the validity of a victim’s claim.

Taking the First Step Toward Healing and Seeking Justice

Since preserving evidence in sexual assault cases is crucial to building a case against perpetrators, it is vital to gather and preserve all relevant evidence. However, navigating the legal process during this difficult time can be overwhelming and daunting. By seeking legal guidance, you may better protect your rights and take the first step toward healing and seeking justice.

The way premises liability laws typically work when it comes to commercial properties is that property owners have a responsibility to keep the property as safe as reasonably possible for those with a right to be on the property – for example, employees and customers.

If someone is deemed to be a trespasser, however, that responsibility (also known as a “duty of care”) is significantly lower. For example, if someone climbs over a fence marked with “No Trespassing” signs and steps in a hole or slips on ice, they likely can’t seek compensation for their injuries since they had no right to be there.

Under Michigan law, a property owner “owes no duty of care to a trespasser and is not liable to a trespasser for physical harm caused by the possessor’s failure to exercise reasonable care….”

Of course, there are all kinds of “trespassers.” A person who enters a store after it’s closed to steal is very different from someone who is curious about an empty office space and walks in through an unlocked door to look around. However, neither may have any recourse if they’re injured.

When Can Property Owners Be Liable for Injuries to Trespassers?

Property owners and others in charge of a property (like renters or leasees) have some duty of care to trespassers. Michigan law says they “may be subject to liability for physical injury or death to a trespasser” if they knew or should have known of a trespasser’s presence and “failed to use ordinary care to prevent injury to the trespasser arising from active negligence.” The same is true if they knew or should have known that “trespassers constantly intrude on a limited area of the land.”

The law also states that property owners may be held liable if they “injured the trespasser by willful and wanton misconduct.” For example, they can’t “booby trap” a property with the intention of injuring trespassers. They also can’t just shoot anyone who sets foot on their property without permission if that person’s not breaking into a structure or threatening harm.

Note that these sections of the law apply to adults. Property owners owe a greater duty of care to children who may be technically trespassing. The law assumes that children may not be able to fully understand the potential risks of trespassing.

If you or a loved one has been injured on a commercial property by a hazardous condition and are facing pushback from a property owner with accusations of trespassing, it’s smart to get legal guidance. This can help you determine your right to compensation under Michigan law.

Sexual assault is a traumatic experience that can leave the survivor with physical, emotional and psychological scars. Trying to navigate the path toward healing can often feel overwhelming and sometimes impossible.

While each survivor’s life journey is unique, finding ways to work through the effects of the sexual assault and learning to live life again is critical. These tips may be beneficial for individuals who are having to do this.

Recognize That You Aren’t to Blame

One of the first steps in healing after a sexual assault is recognizing that you aren’t to blame for what happened. You may notice that you have a plethora of emotions about the situation. You may feel anger, shame, confusion or fear. Through all of those, remember that your attacker is the one to blame, so you shouldn’t blame yourself at all. Everyone in this situation will have to handle things in the way they feel is best, so try to focus on what helps you to move past the attack.

Seek Mental Health Help

A sexual assault can cause significant mental trauma. Seeking assistance from a mental health professional enables you to include different types of therapy and potentially medications as part of your treatment plan. It may also help to join support groups, even virtual ones, to connect with other survivors of sexual assaults.

Empower Yourself

Reclaiming your independence is a major step in healing, but this is something that won’t happen all at once. Try participating in hobbies and activities that you enjoy. Celebrate even the small victories, such as getting out of bed when it’s difficult. Each of those little things can help you regain control of your life.

Victims may be able to take legal action after a sexual assault. The case filed in civil court aims to help them recover the costs of medical and mental health care, as well as other expenses related to the attack. These cases can be complex and emotional, so it may be best to work with someone who can help you through the legal matters.

Motorcyclists are at high risk on the road because car and other vehicle drivers frequently don’t notice them. This lack of attention can cause serious crashes and even deaths. Why do drivers often overlook motorcycles and their riders?

Motorcycles Are Much Smaller Than Other Vehicles.

Drivers often miss seeing motorcyclists because motorcycles are much smaller than cars, trucks and buses. Motorcycles have a much narrower profile, and other vehicles, road signs or even roadside barriers can easily block them from view. This makes it hard for drivers to see motorcyclists, especially in busy traffic or at high speeds.

Motorcycles Are More Likely to Fall Entirely in a Driver’s Blind Spot.

Every vehicle has blind spots where the driver cannot see nearby objects through the mirror. Motorcycles are small enough to fit perfectly into these blind spots, especially for larger vehicles like SUVs and trucks. If a driver does not check over their shoulder before changing lanes or turning, they might completely miss seeing a motorcycle.

Drivers Are Often Distracted.

These days, distractions are everywhere. Texting, talking on the phone, using a GPS, or even changing the radio can distract a driver from focusing on the road. Over 60 percent of people admit to using their phone while driving, and many others say they eat, apply makeup or even take photos while driving. Even a short distraction can prevent a driver from noticing a motorcycle.

Drivers May not Be Looking for Motorcyclists.

Drivers are used to looking for cars and trucks, not motorcycles. This is called “inattentional blindness.” It means that even if a driver is looking right at a motorcycle, they might not see it as a vehicle, especially when driving fast. This cognitive blind spot can lead to dangerous oversights.

Drivers May Misjudge the Speed of a Motorcycle.

Motorcycles can speed up quickly, and drivers in larger vehicles might have trouble judging how fast a motorcycle is moving. If a driver glances quickly and underestimates the motorcycle’s speed at an intersection, they might go ahead and cause a collision.

It is important that motorcyclists get the same safety consideration as those in larger vehicles. Knowing the risks motorcyclists face and taking steps to increase your visibility can help you keep the joy of motorcycle riding safe.

People may end up facing criminal charges in Michigan for many different reasons. Common criminal accusations include claims that someone drove a vehicle while under the influence or possessed illegal drugs.

Those accused of breaking the law often want to resolve their pending legal matter as quickly as possible. They may consider pleading guilty to the charges that they face. Doing so may seem like a simple and straightforward solution.

Many people hope that a guilty plea might limit the penalties the courts impose. However, defendants often secure the best outcomes in cases where their attorneys negotiate plea bargains on their behalf instead of just entering a guilty plea.

What Does Negotiating a Plea Bargain Involve?

Many defendants seek out plea bargains. According to a recent analysis of the outcome of criminal charges in the United States, the vast majority of people accused of criminal offenses plead guilty. Often, they plead guilty through a plea bargain arrangement.

Instead of just entering a guilty plea and leaving themselves at the mercy of the courts, the defendant instead has their lawyer negotiate with the prosecution. Plea bargaining often involves requests to limit the penalties that the courts impose. A prosecutor can agree to reduce the amount of jail time possible by accepting a plea to a lesser offense.

They can also negotiate to take certain penalties off the table entirely in some situations. Plea bargains can also involve limiting what information the prosecutor submits to the court as part of the public record. Doing so can help preserve the reputation of a defendant in exchange for their decision to plead guilty.

Essentially, plea bargaining involves a defendant agreeing to plead guilty in exchange for certain concessions from the prosecutor’s office. The nature of the charges the defendant faces, the penalties the courts could impose and the circumstances leading to their prosecution all influence the best strategy when attempting to negotiate a plea bargain.

Learning that leniency comes from a negotiated arrangement rather than just entering a guilty plea can help defendants avoid scenarios in which they may unintentionally give up their only leverage early in a criminal case. A solid criminal defense strategy involves not just an attempt to counter the state’s case but also an analysis of every available option. Plea bargaining is a valuable option for many people facing criminal charges.

Ideally, business flows smoothly with minimal interruptions. Once a company establishes its presence in a certain niche, daily business operations become somewhat predictable. However, disputes can arise that complicate daily operations and raise questions about the future of an organization.

Business conflicts can impact a company’s reputation and damage employee morale. There are many potential sources of conflict when running a company, but the three below are among the most common.

1. Partnership Disputes

It is common practice for those with a new business concept to take on a partner. Their partner can help fund the business or provide industry contacts that make it easier to start your company.

Partners may find themselves disagreeing about whether each partner fulfilled their promises to the other or about the future of the organization. Partnership conflicts sometimes result in buyouts, or they may result in the company closing down in other circumstances.

Business partners often need to work assertively to reconnect with one another and improve their business relationship after a disagreement about their arrangements or the company that they run together. Clear contracts can reduce the likelihood of major partnership disputes and can provide a plan for their resolution.

2. Shareholder Disputes

For larger organizations, taking on shareholders may be part of funding the company’s expansion. Those shareholders may then have differing opinions than entrenched leadership about the future of the organization.

Shareholder disputes may result in lawsuits and operational disruptions. If those running an organization can’t find a way to cooperate with those who have invested in it, the organization could face complex legal issues.

3. Disputes With Other Companies

There are many scenarios that might lead to disputes between two separate organizations. Companies may need to negotiate or litigate matters related to a contract breach.

Other times, there might be allegations of unfair competition and even corporate espionage. Disputes with other businesses can affect a company’s reputation and its market share. Depending on the nature of the dispute, the disagreement could also affect operations.

Clear contracts, appropriate organizational documents and an understanding of applicable regulations can all go a long way toward helping minimize and resolve business disputes. People in leadership positions may need help evaluating and responding to disputes involving their companies.

Many people have insurance for their home or vehicle. This insurance can help cover the potential cost to repair or replace property after an incident.

However, if an insurance company fails to provide an owner with fair compensation for property damages, the owner must file a property damage claim. Here is what you should know:

Why Would You Need to File a Property Damage Claim?

Property damage may occur as a result of natural disasters (flooding, fires, hail, etc.) or accidents (vehicle accidents, fallen trees, etc.). Damages could lead to security and safety risks, emotional distress and financial difficulties for owners.

Unfortunately, insurance adjusters exist to protect the insurance company – not pay claims. An adjuster may seek to unfairly deny or devalue a claim. In those situations, the property owners need to aggressively assert their rights.

What Can You Recover From a Successful Property Damage Claim?

The type of compensation that can be recovered from a property damage claim often depends on the cost of repairing or replacing the property. Some common damages that can be recovered with a property damage claim include:

Residential property damages: Repairs to a home may include fixing the roof, plumbing, foundation, doors or windows.

Commercial property damages: A business owner may seek repairs or replacements for company vehicles, destruction of products or theft.

Vehicle damages: A vehicle owner may seek damages to cover the costs of vehicle repairs or rental costs after an accident or natural disaster.

Personal property: Individuals may seek replacements for electronics, tools, jewelry or other valuables.

Replacing or repairing property may not be the only cost that can be recovered with a property damage claim. In some cases, the cost to clean up damages, relocate residents or locate replacement parts can lead to additional expenses.

How Long Do You Have to File a Property Damage Claim in Michigan?

It is crucial to understand that a property damage claim must be made within a deadline. In Michigan, the statute of limitations for a property damage claim is three years. This lawsuit can seek to repair or replace damaged or destroyed property. Failing to file a claim within three years could prevent a property owner from recovering compensation.

Legal guidance is available to property owners seeking fair compensation for their damages and losses.

Many medical providers face issues collecting full compensation for their services to their patients. In addition to providing medical services, providers may need to take steps to manage collections to avoid revenue loss and financial difficulties.

There are a few expected challenges when collecting payments from patients. Read the following to learn about these challenges and how to improve efficiency:

1. Complex Insurance Claims

One of the many problems with insurance claims is that there are many varying policies, limitations and conflicting coverages. A denied insurance claim can make it much harder for medical providers to receive payment for their services.

It is often crucial to review and verify a patient’s medical coverage before providing services, such as co-pays and deductibles. If a patient’s insurance does not cover their medical needs, providers may need to review their options.

2. High Patient Bills

Providers and patients are both facing the difficulties of rising healthcare costs and high-deductible insurance plans. In many cases, patients are responsible for higher medical bills. This can make it harder for them to pay their bills as they take on more medical debt.

A possible way to collect payments for medical services is to provide transparent billing statements. These statements can clearly outline what a patient owes, when the payment is due and their available payment options.

3. Ineffective Collection Processes

Medical providers often face difficulties collecting payments because of billing issues, inefficient collections and delayed payments. Some of these issues are the result of a lack of training.

Medical providers need to explore their options to improve the efficiency of collections. This could mean training staff on best collection practices and outsourcing with a collection agency.

4. Issues With Patient Communication

Some patients are not aware of their financial obligations and, as a result, fail to pay for their services. In some cases, a medical provider fails to notify their patients what they owe.

Establishing strong communication with patients is often essential to collections. Providers could set up automatic payment plans, payment notifications through email and text and automated calls to remind patients of their bills.

5. Technology Barriers

Many providers use outdated systems to collect payments. However, this could be creating an issue with both younger and older patients. Younger patients may not have access to outdated systems, and older patients may not know how to work online services.

Providers may need to explore their technology options to collect payments. User-friendly services could help patients make their payments.

Delayed payments can severely harm medical providers and their practices. Legal guidance can protect providers from financial strain and get payments back on track.

For many people, dogs are loving and loyal companions. However, like most animals, they may bite their owners or strangers for a variety of reasons. In the event of a dog bite, victims may suffer serious health complications if they don’t seek medical intervention.

Understanding when a dog bite requires medical attention can help victims address their injuries before they get out of control. Victims of dog bites can also benefit from knowing how to hold a dog owner accountable for personal injury.

When to Seek Medical Attention for a Dog Bite

A dog bite victim should seek immediate medical assistance if the bite:

Penetrates deep into the skin

Damages muscles

Causes excessive bleeding

In such instances, immediate medical attention is necessary to prevent infection and help ensure proper wound care.

Victims should also rush to the nearest hospital if their wound becomes red, swollen, warm or discharges pus. These signs may indicate that the wound may be infected. Other signs include fever, chills and swollen lymph nodes. Dog saliva carries bacteria like Pasteurella and Capnocytophaga, which can cause severe infections in a bite wound that’s left untreated.

Medical intervention is also required if direct pressure does not stop the bleeding within 10 to 15 minutes. Excessive blood loss can be dangerous and might indicate damage to an artery or vein.

If a victim experiences numbness, weakness or difficulty moving the affected area, the bite may have caused nerve or tissue damage. A doctor should evaluate the injury to determine the best course of treatment.

Holding the Dog Owner Accountable in Michigan

The Greate Lake State follows the Michigan Dog Bite Statute (MCL 287.351) for dog bites. According to this legislation, dog owners can be held liable for injuries caused by their dogs, even if the dog has never bitten anyone before. The dog bite victims can pursue compensation if the bite occurred in a public place. However, the victim needs to demonstrate that they did not provoke the dog in any way.

Dog bites can lead to serious health complications for unsuspecting victims who get attacked. Seeking prompt medical attention can help ensure proper treatment and prevent complications. Victims bitten by a dog in Michigan generally have the right to hold the owner accountable for their injuries if they didn’t provoke the aggressive dog at issue.

Buckling your seatbelt each time you get in a vehicle is a simple and effective way to protect yourself. Michigan law mandates that all drivers and passengers wear seatbelts, emphasizing the importance of this safety measure.

Wearing a seatbelt reduces the potential for serious injury and death. This is done by keeping occupants securely in place and making sure they are not thrown or ejected from the vehicle when a collision occurs. Compliance with these laws is about avoiding fines and, more importantly, safeguarding lives.

Here, you can learn more about the importance of wearing a seatbelt in a car accident.

Impact on Compensation Claims

In the event of a car accident, wearing a seatbelt can have a significant impact on any potential compensation claims. Michigan follows a modified comparative negligence rule. This rule states that you may be considered partially at fault for injuries if you do not wear a seatbelt. If this happens, then the compensation you receive may be reduced.

For instance, if you are deemed 30% at fault for not wearing a seatbelt, your compensation would be reduced by that percentage. This underscores the importance of always wearing a seatbelt to ensure you can claim the maximum compensation possible.

No-Fault Insurance and Seatbelt Use

Michigan operates under a no-fault insurance system, which means that in the case of an accident, your insurance covers your medical expenses and lost wages, regardless of who was at fault.

However, if injuries are severe and compensation is sought beyond no-fault benefits, proving that you were wearing a seatbelt can strengthen your case. It demonstrates that you took necessary precautions, which can be pivotal in legal proceedings and settlement negotiations.

Always wearing a seatbelt is not only a legal requirement in Michigan but also a critical factor in protecting your health and maximizing your compensation in the event of a car accident. Legal guidance can further help you navigate these situations and secure the compensation you deserve.

It’s no secret that tailgaters are dangerous. You certainly feel this danger when someone starts tailgating you, as it probably makes you a bit nervous and stressed out. You know that they might cause an accident at any second – and you may be injured due to their negligence.

Some people will quickly hit the brakes to try to get the tailgater to back up, but you shouldn’t do this. It may cause the accident, and your decision to intentionally hit the brakes may mean that you are liable and the accident could be your fault. So what should you do?

Slow Down Gradually

Slowing down isn’t necessarily a bad idea, but you should do so gradually. For instance, rather than hitting the brakes, just take your foot off of the gas pedal. If the tailgater is just looking for a chance to pass, it’s easier for them to do so at a lower speed.

After all, your main goal should be influencing that tailgater to pass your car. That is what will keep you and anyone else in your vehicle safe. Don’t let ego get in the way. Just let them pass and continue driving safely.

In fact, there are some situations in which slowing down won’t be enough. You may need to pull over to the side of the road, pull into a parking lot or even change lanes. But your goal remains the same: You want the tailgater to pass your car as soon as possible.

What if You Get Injured?

Even if you try to do the right thing, the tailgater could cause an accident that leads to serious injuries. Be sure you know about all the legal steps you can take to seek financial compensation.

Getting doored is something that can happen to a cyclist when they are riding near a line of parked cars. These cars may simply be parked on the side of the street, as the cyclist is riding on the right-hand edge of the travel lane. In some cases, there will even be parking spaces on the street with a dedicated bike path running along next to them.

In either case, the danger to the cyclist is that someone may get out of one of those parked cars. This could happen unexpectedly and very suddenly. As soon as the door swings open, the cyclist runs into the open door, causing a severe high-speed crash. There are also dooring cases where the person will step out of the car and the cyclist will hit them directly.

Why Does It Happen?

The simple reason why this happens is that people in vehicles often do not check to see if it’s safe for them to step out into the street. Drivers could always avoid dooring accidents if they just looked in the mirrors to see if a cyclist was coming up behind them. And, while many drivers do check each time, there will always be drivers who fail to do so.

Why Can’t the Cyclist Avoid the Crash?

The blame doesn’t fall on the cyclist because they likely have no choice. They don’t have enough space to stop and they can’t swerve to the left or they would be riding their bike into the oncoming traffic lanes.

Seeking Compensation

Are you a cyclist who has recently been injured by a negligent and inattentive driver? If so, you need to know how to seek financial compensation for medical bills and more.

Hospitals are among the most profitable targets for ransomware attacks. The ability of their systems to work as they should can literally mean the difference between life and death.

There’s crucial monitoring equipment, of course. Further, the electronic health record (EHR) systems are necessary to keep patient data current and to allow staff to access this data as needed to treat patients. Hospital systems also house confidential patient information subject to Health Insurance Portability and Accountability Act (HIPAA) regulations.

Unfortunately, that means hospitals sometimes pay up to six-figure ransoms to keep everything running – even though that’s not recommended. Unfortunately, sometimes they don’t even report the attack to authorities.

The problem of ransomware attacks on hospitals has gotten so bad that the Centers for Medicare & Medicaid Services (CMS) has announced a plan to include a facility’s “cyber hygiene” as a factor in determining whether it gets funding. That plan is scheduled to go into place later this year. This will likely include things like having digital security tools such as multi-factor authentication. One Biden administration official said it’s “homing in on those key cybersecurity practices that we really do believe bring a meaningful impact.”

When Can a Hospital Be Held Liable for Patient Harm During a Ransomware Attack?

There’s no way to know how many patients have been harmed or have died because of ransomware attacks – in part because the attacks aren’t always reported. Whether a hospital can be held liable for this harm can depend on a number of factors. For example:

Did it neglect to put protections in place that would have prevented the attack?

Did it have back-up systems in place to protect patients during the attack?

Did staff notify patients and families of the issue and what was being done?

Did it notify the appropriate authorities and agencies so that ambulances could be rerouted?

Sometimes, a ransomware attack occurs despite a hospital’s best efforts to prevent it, and it has a plan in place to help minimize the effect on patient safety. However, if that’s not the case and a patient suffers harm or worse, it’s worthwhile to find out whether a malpractice claim is possible.

You may be entitled to compensation for an accident caused by a negligent driver in Michigan. However, your actions after the crash may determine whether you will receive the compensation you deserve. In other words, they can make or break your car accident claim.

Below are the common pitfalls that could complicate the settlement process and jeopardize your claim.

Not Seeking Medical Attention

It’s important to see a doctor even if you don’t feel any pain or discomfort. Seeking medical attention is not just good for your well-being, but it also provides formal documentation of your injuries. You may need to show your injuries were caused by the crash or demonstrate their severity, which may be impossible without medical evidence.

Failing to Report the Accident

It’s advisable to contact law enforcement after an accident. The police report at the crash scene can be crucial evidence of the circumstances that led to the accident. In addition, Michigan law requires drivers to report an accident that results in injury, death or property damage exceeding $1,000 to the police. Failing to report the accident can lead to legal issues.

Not Notifying Your Insurance Company

You should report the accident to your insurance company immediately after it occurs, even if you believe the other driver was to blame. Your insurance policy should specify when you must notify the insurer, and it’s best to adhere to the requirements.

When speaking to your insurer, do not give unnecessary details about the crash or admit fault. Be concise and straight to the point.

Settling too Soon

Do not rush into early settlement offers without careful consideration as you may settle for less than you deserve. Furthermore, you cannot request additional compensation once you agree to close your claim.

Overlooking Legal Guidance

Certain legal complexities in your case may affect your car accident claim, like shared responsibility for the crash or disagreements over what exactly happened. Seeking qualified legal assistance can help address such hurdles and protect your interests throughout the claims process.

When summer soon arrives, it will mark the start of what traffic safety experts call the “100 Deadliest Days.” This period runs from Memorial Day to Labor Day. During these months, the number of crashes involving teenage drivers spikes significantly. That’s why it’s crucial for parents to begin preparing their teen drivers to remain safe on the roads well before summer starts.

Teen drivers often have less road experience under their belts than adult motorists do, which can make driving safely a challenge, especially in busy summer traffic. This inexperience can lead to mistakes if they’re not prepared. As such, getting in practice in the spring months can help teens to better navigate the challenges of summer driving.

What Can You Do to Help Your Teen?

If you’re the parent of a relatively inexperienced teen driver, consider engaging in the following this spring, in anticipation of summer hazards:

Practice together: Spend time driving with your teen. Go on both short and long trips, and practice on different roads and at different times of day. This variety can help them learn how to handle various driving situations.

Set rules: Make clear rules about using phones, the number of friends in the car and where and when they can drive. Setting informed limits can reduce the risk of accidents.

Talk about risks: Discuss the serious risks of driving, like speeding and drinking alcohol. Make sure your teen knows how important it is to follow the law and make smart choices.

Additionally, you’ll want to keep in mind that teens learn a lot by watching their parents. When you’re driving, show good habits like wearing your seatbelt, following speed limits and not using your phone. This can set a positive example for your teen as you work to keep them safer in more “hands on” ways this spring.

Since the late 1990s, driver and front passenger airbags have been required safety features in all cars – and they definitely save lives.

Airbags aren’t perfect, however. Despite their role in vehicle safety, airbags can also cause injuries to unlucky drivers and their passengers under certain circumstances.

Why Do Airbag Injuries Happen?

There are a variety of reasons that airbags can cause injuries, including:

Design flaws: Airbags were largely designed with men in mind. Only recently have female crash-test dummies been used, and they are not mandatory for testing. Women are injured far more often and more seriously than men in wrecks, partially because airbags are not designed with their bodies in mind.

Malfunction: Sometimes an airbag doesn’t open when it’s supposed to open in a crash. Other times, airbags will deploy when the vehicle is barely tapped – which they are not supposed to do. The force of deployment can end up causing serious injuries.

Installation issues: Incorrect installation of airbags at a dealership or repair shop can compromise their effectiveness and increase the risk that someone will get injured when the airbags are deployed.

There are also numerous possible injuries associated with airbags. Their rapid deployment can cause injuries to a driver’s or passenger’s face, neck, chest and arms. Eye injuries, including corneal abrasions and retinal detachments, are common. Some victims also experience damage to their inner ears, leaving them with tinnitus or permanent hearing loss.

If you’ve been injured in a wreck and your injuries were at least partially caused by the airbag, you may want to consider legal guidance. You may be able to hold more than just the other driver accountable for your losses.

Determining suitable settlement terms for your car accident claim can be a complex undertaking, but it is crucial to securing the compensation you deserve. Various factors can influence the amount you can recover after a crash.

First in line is the extent or severity of your injuries and the ensuing damages. This includes the impact on your daily life, duration of recovery and all other present and future losses. Your settlement should cover all your damages as it’s meant to make you as “whole” as you were before the crash.

Presenting evidence of your damages can help strengthen your claim. This may include medical records, bills, receipts and documentation of your losses. The stronger the evidence in your support, the more likely you are to receive a fair settlement.

Your Degree of Fault Will Come Into Play

Liability for the accident is crucial. If you played a role in the crash, it may affect your ability to recover compensation or reduce the amount you are entitled to. For instance, if you are 30% at fault, you can only recover 70% of your damages. Remember, you cannot file a car accident claim against the other party if you were more than 50% responsible for the crash, at least in most jurisdictions.

The Negligent Party’s Insurance Coverage Matters

The insurance policy limits of the at-fault party can also impact your settlement. If the at-fault party’s insurance policy has low limits, it may limit the amount you can recover, especially if your damages are significant. However, you may have other options in such situations.

If you have been in a car accident, it’s important to seek legal guidance to understand your rights and to better ensure that you receive fair compensation for your damages. There is too much at stake to risk a low settlement as a result of “DIY” missteps.

Medical workers have a duty to provide a standard of care that minimizes the risk of birth injuries during childbirth. When medical negligence occurs, severe birth injuries can result, profoundly impacting both a newborn and their family.

Some of the birth injuries that can result from negligence by medical workers subject babies and their family to life-long physical, emotional and financial challenges. For example, the following are four severe birth injuries that can occur due to medical negligence.

Brain Damage

Mishandling of the birthing process, improper use of birthing tools such as forceps or vacuum extractors, delayed cesarean section when necessary or failure to monitor fetal distress adequately can lead to brain damage in newborns. Oxygen deprivation during labor and delivery, known as birth asphyxia, is a common cause of brain damage due to medical negligence. This can result in conditions such as cerebral palsy, developmental delays, cognitive impairments and seizures, profoundly affecting the child’s quality of life and requiring extensive medical care and support.

Spinal Cord Injuries

Newborns are delicate and any mishandling during the birthing process can result in severe spinal cord injuries. Improper positioning of the baby, excessive force during delivery or failure to address complications promptly can lead to damage to the spinal cord, causing conditions such as paralysis or impaired motor function. Spinal cord injuries can have lifelong consequences, affecting the child’s ability to move, control bodily functions and participate in daily activities independently.

Skull Fractures

If medical workers are not careful during delivery, they may mishandle the baby’s head, leading to skull fractures. Improper use of forceps or excessive traction during delivery can cause fractures to the delicate bones of the skull. Skull fractures can result in severe pain, swelling and, in some cases, intracranial bleeding or brain injury. These injuries can have long-term consequences, including developmental delays, cognitive impairments and neurological deficits, impacting the child’s overall health and well-being.

If you believe that your child has suffered a severe birth injury due to medical negligence, it’s crucial to seek legal guidance promptly. Legal counsel can help you understand your rights and options for seeking compensation to cover the extensive medical expenses, ongoing care and other damages resulting from the negligence.

If you visit a doctor and they realize your diagnosis or treatment is beyond their skills, they are required to refer you to a physician with more specialized knowledge and skills. However, doctors don’t always refer patients when they should. If you’re ill or injured, your doctor may fail to refer you or to do so in a timely manner. This is referred to as failure to refer.

Is this failure considered medical malpractice? When a doctor agrees to treat you when you request their services, a legal duty of care is created. This means they need to provide you with reasonable care, including noticing if you need the services of a specialist and referring you to them. A failure to do so could lead to grounds upon which to file a medical malpractice claim if other legal elements are met in re: your situation.

Did the Doctor Breach Their Duty of Care?

By not referring you to a specialist or doing so on time, your doctor may have breached their duty of care. If another physician with the same competence as your doctor would have made a referral in a similar situation, that failure may constitute professional negligence.

Did the Failure to Refer Harm You?

For a failure to refer to be considered medical malpractice, you will need to prove that the breach of duty of care in question caused you harm. Failure to refer can lead to several issues, including worsening a condition. For example, if a doctor notices a tissue mass that resembles a tumor, but fails to refer you to an oncologist for further tests, you may be diagnosed with cancer at an advanced stage, harm that could have been avoided or minimized by a timely referral.

If you can prove the above-discussed elements, you may be in a strong position to hold your physician accountable for medical malpractice. Seeking legal guidance is a good way to learn more.
